THE ATTORNEY GENERAL HAS RAISED 5 PRELIMINARY OBJECTIONS AGAINST 2 CASES FILED BY HUMAN RIGHTS DEFENDERS IN TANZANIA The AG has raised one preliminary objection against the case number 36 of 2019 petitioned by Mr. Onesmo Olengurumwa and four preliminary objections against the case number 35 of 2019 petitioned by Mr. Paul Kisabo, both cases were filed against the AG on 16th December 2019 at the High Court of Tanzania, Dar es Salaam Main Registry. Mr. Olengurumwa is challenging in court the whole process of committal proceedings while on the other hand Mr. Kisabo is challenging the denial of bail to persons charged with economic offences like money laundering. The first mention of both cases was held on 13th February 2020 at the High Court of Tanzania where the AG was ordered to file his reply to the petitions within seven days, by latest 20th February 2020. On that day, both cases were adjourned for mention on 25th February 2020. In reply to the petitions, the AG has raised a preliminary objection with regard to the case number 36 of 2019 that, the petition is incompetent and bad in law for being Res Judicata. In respect of the case number 35 of 2019, the AG has raised the following four preliminary objections:- 1. That, the affidavit in support of the petition is incurably defective and bad in law for containing a defective verification contrary to Order VI Rule 15(3) of the Civil Procedure Code [Cap 33 R.E 2002] 2. That, the petition is incompetent and bad in law for being Res Subjudice 3. That, the petition is incompetent and bad in law for contravening sections 3 and 4 of the Basic Rights and Duties Enforcement Act [Cap 3 R.E 2002] 4. That, the prayer sought by the petitioner is untenable in law. The Attorney General was represented by the State Attorney, Kalokola Stanley who prayed before the High Court to schedule both cases before one Judge in order to determine the Preliminary Objections before indulging into the merit of the case. The Bench of three High Court Judges: Masoud, Magoiga and Masabo JJJ, adjourned both cases and scheduled another date for mention.
