CONSULTANCY FOR CONDUCTING A CASE-BASED STUDY ON DRACONIAN LAWS THAT AFFECT HUMAN RIGHTS DEFENDERS IN TANZANIA

Tanzania Human Rights Defenders Coalition (THRDC) is a non-governmental, non-partisan human rights organization registered under the Non-governmental Organizations Act of 2002. As an umbrella organization, THRDC comprises more than 170 individual and organizational members who are Human Rights Defenders (HRDs) including journalists. These HRDs operate widely from across Tanzania mainland and Zanzibar under the coordination of THRDC’s Zonal Coordination Units.
Under the current five years, strategic plan The Tanzania Human Rights Defenders Coalition has stemmed its focus in various initiatives geared at ensuring the Civic space is widened. Under the current regime, various factors indicating the shrinking of civic space are observed which among others includes the promulgation of suppressive laws which has eventually reduced the working space of HRDs. Human rights defenders have been facing various challenges while implementing their human rights promotion and protection roles resulting from promulgation and adoption of different suppressive laws including media service laws.
Many HRDs and journalists are increasingly becoming targets of harassment and intimidation, with a number of Civil Society Organization (CSOs) workers often accused of being agents of foreign interests or supporters of opposition parties. Currently, there are a number of pending investigations in Police stations, especially the Cyber Crimes departments, Tanzania Communications Regulatory Authority, pending and decided cases in courts of Law regarding issues of the freedom of association, freedom of assembly, freedom of expression and the right to information.
Under these circumstances, THRDC is planning to conduct a comprehensive survey and analysis of court decisions, pending cases both in courts, TCRA, police cyber Crimes units, which has imposed more hardship for HRDs to operate resulting from the newly promulgated draconian laws. Therefore, THRDC is looking for a qualified individual or firm to assume the assignment on a consultancy basis.
The main objective of the assignment is to review and document HRDs cases Pending investigations in police stations, Regulatory Authorities, pending and decided cases in courts of Law which resulted from the suppressive laws and mainly the cyber-crimes Act 2015, Online content Regulations 2018, The media services Act 2016, Regional Administration Act 1997, Police Force and Auxiliary Services Act 1969, the statistics Act 2016, Access to Information Act, 2017.
i. To study and understand several pending investigations in police stations, pending and decided cases in courts of Law on the draconian laws.
ii. Loopholes of the draconian Laws which makes it less functional and the consequences of such loopholes on human rights.
iii. Propose suitable amendments to be incorporated to the draconian Laws hence able to regulate various issues but in a constitutional manner.
iv. Number of victims (convicts)
v. Number of pending cases at TCRA, Police and in court.
vi. Number of finalized court cases.
vii. To develop a comprehensive analysis of Court Decisions in relation to challenging legal provisions governing CSOs and Human Rights Defenders in Tanzania.
viii. To submit a well-prepared case-based analysis of the draconian laws which have been used by the court in ruling against Human Rights Defenders in Tanzania Mainland and Zanzibar
The consultant must include within the technical proposal a well-defined survey methodology including desk work and field data collection. Under this assignment, the Coalition is interested with both quantitative and qualitative
Upon successful completion of the task, the consultant is expected to:
a. Submit a fully developed case-based analysis of the draconian laws, which have been used by the court in cases involving Human Rights Defenders in Tanzania Mainland and Zanzibar.
b. List of pending and finalized cases involving draconian laws.
c. A well-documented Recommendation to the secretariat on how to address/challenge the suppressive laws.
2. QUALIFICATIONS AND EXPERIENCE
The Consultant should have but not limited to the following qualifications and experience;
i. An applicant must be Fluent in English and Swahili languages.
ii. An applicant must have a Bachelor’s degree or advanced level in Law or any related field.
iii. An applicant must have a sound knowledge on civil societies and human rights defenders in Tanzania.
iv. An applicant must have an experience in litigation on issues of human rights.
