KABENDERA FACE TO FACE WITH THE DIRECTOR OF PUBLIC PROSECUTIONS (DPP) TO REVIEW HIS PLEA BARGAINING AGREEMENT

The Economic Crime case No. 75 of 2019 against Investigative Journalist, Erick Kabendera has been adjourned yet again for the 16th times today on 17th February, 2020 at Kisutu Resident Magistrates’ Court.
The Senior State Attorney, Faraja Nchimbi earlier today, informed the court that they are planning to meet face to face with the accused person, Mr. Erick Kabendera and his advocates to negotiate the plea bargain agreement. The reason behind was that, since 11th October 2019 when the defense counsels notified the court about the intention to negotiate in lieu of section 194 A (2) of the Criminal Procedure Act, only the Republic and Kabendera’s relatives met to negotiate in absence of Mr. Erick Kabendera.
“It’s an appropriate time to reach a plea bargain agreement with the accused person. We hope that, before the court adjourns we can be able to meet in person and discuss with the accused person and reach a conclusion.”, stated Senior State Attorney Faraja Nchimbi.
The defense counsels conceded to the request made by Senior State Attorney Faraja Nchimbi who also requested the court to schedule another date for mentioning.
It should be recalled that, on 5th August 2019, Investigative Journalist Erick Kabendera was charged with three unbailable charges: Leading an Organized Crime, Failure to pay Tax and Money Laundering amounting to 173 Million Tanzanian Shillings.
Mr. Erick Kabendera has been in remand at Segerea prison since his arbitrary arrest by police officers at his Mbweni residence in Dar es Salaam on 29th July 2019.
